contract

terms and conditions

By submitting this form, the Client expressly agrees to be bound by all Terms and Conditions contained herein and acknowledges that this agreement forms a legally enforceable contract between the Client and Animist.

The Client agrees to fully and accurately disclose, to the best of their knowledge, all information relevant to the Dog’s behavioural history. This includes, but is not limited to, any incidents or indications of aggression, reactivity, fear-based behaviours, bite history (including warning bites or nips), and any known triggers or circumstances that may provoke such behaviours.

The Client further agrees to disclose any and all prior training undertaken by the Dog, whether conducted by the Client, a previous owner, or any professional trainer or behaviourist. Such disclosure must be made prior to the commencement of services and updated promptly should new information become available.

The Client understands that failure to provide complete and accurate information may increase the risk of injury or impede the Trainer’s ability to provide appropriate services, and hereby accepts full responsibility for any consequences arising from nondisclosure or misrepresentation.

The Client agrees to follow all training instructions, guidance, and protocols provided by the Trainer both during scheduled sessions and between appointments. The Client acknowledges that their active participation and consistency are essential to the Dog’s progress and to the effectiveness of the training programme.

The Client further understands and accepts that no specific outcome or result can be guaranteed. Each dog is an individual, and the success of any training plan is influenced by numerous factors, including but not limited to the Dog’s temperament, history, environment, and the level of commitment and follow-through by the Client. Accordingly, the Client acknowledges that the Trainer shall not be held liable for a lack of progress where training recommendations are not consistently implemented.

The Client accepts full responsibility for the Dog’s behaviour at all times, including before, during, and after training sessions. The Client acknowledges and agrees that the Trainer shall not be held liable for any injury, loss, or damage caused by the Dog to persons, animals, property, or otherwise, regardless of whether such incidents occur prior to, during, or following the provision of training services.

The Client further agrees to indemnify, defend, and hold harmless the Trainer from and against any and all claims, demands, actions, liabilities, damages, losses, or expenses (including legal fees) arising out of or related to the Dog’s behaviour or actions. This indemnification applies irrespective of whether the Client is present at the time of the incident.

The Client agrees to pay all training fees in full prior to the commencement of the training programme, unless an alternative payment arrangement has been expressly agreed in writing by the Trainer. Where a payment plan has been agreed, all instalments must be paid in full before the programme concludes. Failure to adhere to the agreed payment schedule may result in the suspension or termination of services without refund.

The Client is solely responsible for attending their scheduled sessions. If the Client cancels a session, the Trainer offers no guarantee that the missed session can be rescheduled. The Client must provide a minimum of 3 days’ notice to cancel or rearrange a session. The Trainer will provide the Client with a minimum of 24 hours’ notice if the Trainer must cancel or reschedule.

Both parties acknowledge that short-notice changes may occasionally be necessary due to unforeseen circumstances such as illness, severe weather, or emergencies, in which case rescheduling may be accommodated by mutual agreement.

The Client agrees that the Dog must remain under control at all times during training sessions. The Dog must be secured on an appropriate lead, and muzzled where the Trainer has deemed such equipment necessary for safety. Failure to muzzle the Dog when instructed will result in the immediate cancellation of the session, and no refund or replacement session will be provided.

If the Client arrives late for a session, the scheduled end time will still apply, and the session may be shortened accordingly.

The Client grants the Trainer full permission to photograph, film, or otherwise record the Client, the Dog, and/or the Client’s property during training sessions. The Client acknowledges and agrees that such media may be used by the Trainer for promotional, marketing, educational, or commercial purposes, including publication on websites and social media. This consent is perpetual, worldwide, irrevocable, and royalty-free.

The Client acknowledges and accepts the inherent risks associated with working with dogs outdoors, including but not limited to uneven terrain, environmental hazards, interactions with other animals, and unpredictable weather conditions.

The Trainer shall not be held responsible or liable for any injury, loss, or damage caused by environmental factors, the Client’s Dog, other dogs, third parties, or any other conditions outside the Trainer’s direct control.

The Client understands that dog training is not a substitute for veterinary care, behavioural medication, or professional veterinary behavioural services. The Client agrees to consult their veterinary provider regarding any health concerns, behavioural medication, or nutritional recommendations.

Any nutritional guidance offered by the Trainer is general advice only. The Trainer accepts no liability for any adverse outcomes, reactions, or issues arising from dietary changes implemented by the Client.

The Trainer reserves the right to discontinue or refuse services where:

The Client employs excessive, harsh, or abusive punishment towards the Dog,

The Client repeatedly ignores safety protocols, training instructions, or professional advice,

The Trainer determines that continued training would pose a risk to the Dog, the Client, the Trainer, or the public.

Such refusal may occur at the Trainer’s discretion and may result in termination of the training agreement without refund.

The Animist Guarantee
Animist offers a conditional satisfaction guarantee (“The Animist Guarantee”) for The Reset Protocol programme. This guarantee is designed to provide reassurance to committed Clients while protecting the integrity of the training process.

1. Conditions for Eligibility
To qualify for The Animist Guarantee, the Client must have fully and consistently complied with all elements of the training programme, including but not limited to:

  • Attending all scheduled clinic calls and coaching sessions, unless otherwise agreed with the Trainer in advance;

  • Completing all assigned homework, training exercises, and action plans in a timely manner;

  • Implementing the Trainer’s guidance consistently between sessions;

  • Providing accurate, honest updates on progress and challenges;

  • Using all required training equipment as instructed;

  • Demonstrating responsible management of the Dog’s environment and behaviour.

Failure to meet any of the above conditions shall render the Client ineligible for the guarantee.

2. Definition of “Measurable Improvement”
“Measurable improvement” shall be determined solely at the Trainer’s professional discretion, and may include (but is not limited to):

  • reductions in intensity, frequency, or duration of problem behaviours;

  • improved responsiveness to training cues;

  • increased ability to cope with triggers;

  • improved handling, engagement, or focus.

The Trainer’s assessment shall be final.

3. Trainer’s Right to Determine Outcome
If, upon completion of the programme, the Client has met all eligibility requirements yet the Trainer determines that meaningful improvement has not been achieved, the Trainer will choose one of the following remedies at their sole discretion:
a) Provide continued support at no additional cost until measurable improvement is reached; or
b) Issue a refund for the programme fee.

The Client acknowledges that the Trainer retains full authority to decide which remedy is appropriate. The Client is not entitled to demand a refund if the Trainer elects to continue providing support.

4. Exclusions
The Animist Guarantee does not apply in cases where:

  • The Client has been inconsistent in following instructions, attending sessions, or completing assignments;

  • The Client has withheld behavioural or medical information relevant to the Dog’s training;

  • The Dog’s progress is impacted by health issues, unmanaged pain, medication changes, or external factors outside the Trainer’s control;

  • The Client has used methods or equipment outside of the Trainer’s guidance;

  • The Client has demonstrated behaviour that prevents effective collaboration, such as hostility, refusal to follow instructions, or unsafe handling.

5. No Guarantee of Specific Outcomes
The Client understands that while the programme is designed to deliver significant improvement, no specific behavioural outcome can be guaranteed, as each dog is an individual and results depend on Client participation.
